Involved in a Cyclist Hit and Run?

Often you hear news of a tragic accident involving a cyclist and the driver ultimately fleeing from the scene. When a cyclist is struck by a motorized vehicle, the injuries to the cyclist can be catastrophic. On average, there are about 74 cyclists fatalities per year across Canada, despite most cities enforcing laws to protect cyclists.

It is important that cyclists know their rights and where to find help in an event of a cyclist hit and run. These types of accidents most commonly attribute fault to the driver of the vehicle.

Reasons behind these accidents usually consist of:

  • Failure to observe surroundings properly
  • Driver speeding/driving recklessly
  • Distracted driving/texting & driving
  • Impaired driving (alcohol/drugs)

Other reasons that these accidents happen include:

  • Failure to observe surroundings properly
  • Cyclists not obeying traffic guidelines and regulations
  • Cyclist riding while impaired (alcohol/drugs)

Compensation

Ontario has one of the most complicated insurance systems in North America when it comes to dealing with cyclists injured on roads. What’s good to know is that if you are a cyclist and have been involved in a hit and run, you are entitled to compensation.

The ability to sue and claim benefits depends on the nature of the accident and the extent of your injuries. You are entitled to pursue potential legal action against the driver of the vehicle that hit you. You are also allowed to claim Ontario's No-Fault Accident Benefit.

Ontario No-Fault Accident Benefit

If you were injured while on your bike you can claim Ontario's No-Fault Accident Benefits through your auto insurance. If you don't have auto insurance, you can submit a claim through the insurance of the owner of the vehicle that was involved. In the event of a hit and run accident where the car strikes you down, you can make your claim to the Motor Vehicle Accident Claims Fund.

In the event of a lawsuit, the cyclist can sue the driver for damages, including the following:

  • Pain and suffering
  • Loss of income
  • Loss of household and handyperson capacity
  • Future cost of care
